Turbo Squid Assets in Video Games

Hello,

I'd like to post a very specific question:
"Can raw assets from turbo squid be used in a commercial video game?"
This includes 3D models and textures which, due to the nature of video games, cannot be pre-rendered, and must exist on disk, possibly in an altered and encrypted file format.

There are several conflicting posts on the forums about this.
Some posts claim you cannot, since this would involve resale of the assets, which is expressly forbidden in the EULA.
Other posts claim you can, as long as the data is encrypted and "not easily extracted".

If possible, I would like this to be answered by a moderator, or even better, to be included specifically as part of the EULA.

LICENSE AGREEMENT BETWEEN VENDOR AND MEMBER


License Grant:

"5. Resale. The resale or redistribution by the third party of any content obtained
from Turbo Squid, whether for sale or freely available for download, whether part of a valid sale
or not, is expressly prohibited."

So it's quite an interesting position TS have got themselves into. According to the above statement anyone including them in a game would be breaking paragaph 5 above because they would be redistributing them.

This needs to be added to the E.U.L.A. and TS would also need notify all the vendors that they plan to do this.

You should open a support ticket and ask them to update their E.U.L.A before someone gets sued. I have mentioned this to them but as usual they just ignore us vendors, too busy counting their cash I guess.

Here is the response I got from a support ticket:

Dear dakarba,

Our EULA accommodates the use of the products on our site in all forms of media. They are used in advertising, television and movies, video games, etc.

Your responsibility is to protect the intellectual property of the Artist by making sure that no matter what your project is, a thrid party cannot access, re-sell or re-use the files that you purchase from Turbo Squid.

In other words, if you buy a 3-D model of a chair and use it in a movie, you can sell and distribute that movie. What you cannot do, is produce that chair as a toy to sell or sell those files to another production company to be used in their project.

If you are using models in video games or software applications, you have to ensure that they are not able to be removed from the software either through encryption or proprietary file types so that the end user cannot extract the model for their own use.

If you need further clarification on this policy, please feel free to let us know.

In my opinion, this is an acceptable condition for a video game - to encrypt the data - and I am happy with this response from the Turbo Squid Support team.
