Question about terms
Posted 31-Jan-2008 3:39 AM

Our company creates softwares for education. We are looking for 3D images. If we buy or download free images form this web site, can we use them and publish them with our software?

If you mean rendered images of 3d models, that is yes, you can. But you can't re-distribute if these images are textures, not rendered images, also you can't re-dictribute 3d models as they is, in 3d-file formats.

However, if you purchase 3D models to render your own images or hire somebody to make the images using those models you should be able to use them in your product (commercial or otherwise).

"can we use them and publish them with our software? "

What kind of software? If it is a 3d software you can't.

Students will use the software to learn geometry. The idea is to use 3D images, import them, play with them, etc..

Will they be able to extract the models from the software? That's the key. If no, then the models can be used for the purpose you have in mind.

No way to extract them
Just use them within the software.

I am not sure still here. Sir, i think you gonna sell your software, isn't it?

3. Rights Granted. The Vendor grants to the 3rd party who either purchases license rights to content via a valid sale, or downloads freely available content submitted by the Vendor, a non-exclusive, non-transferable, worldwide, royalty-free license to: publicly perform, publicly display, and digitally perform said content.

4. Rights Not Granted. Absent a written grant of rights greater than that contained in paragraph 3 above, all other rights or sub-divisions of rights generally included in copyright are excluded from this license.

5. Resale. The resale or redistribution by the third party of any content obtained from Turbo Squid, whether for sale or freely available for download, whether part of a valid sale or not, is expressly prohibited.

No, you're misinterpreting the terms, BlueGreen. He wants to use the models just as any game would, which is well within the EULA. Essentially, he is just "performing" the models, because the models themselves can't be removed from the software and redistributed. What he wants to do is allowed under the TS EULA.

Bibliotheque, if you're still unsure and we have managed to confuse you further, I would suggest opening a Support ticket (upper right-hand side of menu, above) and asking Turbo Squid directly.

Yes, Support ticket would be best solution in this question. I also couldn't understood what is mean "play with models within software". Will the models shipped with the softfare as examples, like 3D Studio Max contain Scene folder, where vatious models are, to play with them in tutorials?

I agree about support ticket too :)

@Hystoria: I understood that students will not be able to extract the models. The issue is what i am not to be sure that models will reproduce and resale.

We want to purchase large city model then PUT our characters into teh model then render the content and sell the rendered content (MP4 video file) to our customers.  This does not seem to fit with your license which says that we can publicly display rendered content.  We want to sell our rendered content.

We will never sell the models or textures, only rendered avi or mp4 files.

Whats the storuy here?  Can we sell our animations to whoever we like as rendered content OR do we need further license permissions?

Yes, you can sell rendered content - 2D or animations, no problem.   Just not the models or textures.
