Hello Kitty--Can I use her in 2d graphic files to sell?

I am so excited that Hello Kitty is here.  As I understand it, I can purchase the model to be used in my 3d program with an export as a 2d image file and I can sell that 2d image file....be it a jpg or a png.

Now, I would like to purchase the more expense Hello Kitty because I need a higher resolution...I DO NOT intend to do any animation, but you never know...she is a cuttie pie.  I am wondering if the little dress can be removed.  I don't think it can.  However, I would like to make 2d graphics with her in a bathing suit, in pants, etc.  Do you think I could get Hello Kitty without any clothes?

Last, I do not understand how you are able to sell this well loved little Kitty.  She is loved all over the world.  I cannot believe that a person who happens to own 3D software can purchase her and make graphics with her.  Isn't she like some icon like Mikey Mouse?  Sorry about being so unknowing about all of this.

Ok, this will be the last thing, I promise.  I have Poser6 and I have a demo of 3d Max which just lasts for a few more days.  Can I load this file into 3d Max export as a Lightwave file and bring up in Poser6?

I hope someone can help me tonight.  That would be very good!!!!  Thank you

No and No...simple do not buy and use.

That 3D file should not even be sold here.Violation of trademark and copyright along with dozens of othe character models (glad you brought that up ...and I suspect that was the reason for post in the first place)

Oh, my gosh...I read your reply several times before it sunk into my head.  I have no right to use pictures I make with my Hello Kitty and sell them???????

Why in the world would Turbo Squid offer models whose renderings cannot be sold????  Unless I just want to make Hello Kitty renderings and put in frame around my house, why did I buy it???

If that product (not the 3d file....that is understood...)....the renderings...cannot be sold??????

If Turbo Squid is allowing copyright infringement models to be sold here, then they must stop....don't they?

I would appreciate feedback.  I did write to Turbo Squid and asked them about this...I HAD to.

You could only use the renderings of the models in a nonprofit fashion to frame in your house for your desktop wallpaper ect and could not be used to "endorse' a nonprofit unless the companies owning the copyright to the original character gave you rights to do so.

The Renderings of that file to be sold would violate the copyrights of the company holding the rights to the character and you in essence would be selling bootleg products and be open to lawsuit and hefty damages in any country that your product "images" ships.

Ask TS to refund your money... i'm sure they will help you promptly.

Boy, am I sad....I just knew that making digital scrapping art with Hello Kitty would help me to get out of the horrible accounting job I have had for 20 years...

If you have any ORIGINAL, CUTE models, please let me know...You are probably not into "Cute," but women ARE and kids ARE.   My Little Pony has been done....Care Bears....all of the greats....Well, I know that I can make all of the digital scrapbook sets I want with little KiKi from RDNA and NOT get sued!!!

I am sorry to be so much trouble, but I REALLY thought sgame had legal rights to model and sell.

Shoot, shoot, shoot......I will go balance some darn checkbooks then instead of playing on the internet and have my dreams squished...(Boss is out of town today...first time in a long time!!!)

Take care and I really do mean that if you come up with something original and cute, I mean cute to women and children, not cute to men...LOL....then let me know.  Heck, I paid $80 for Kitty, which I realize is small potatoes compared to other stuff, but it is a LOT of money to me.

Jan

You may be able to return Hello Kitty for a refund, since it was essentially misrepresented as being a commercially useable product. Imo, there should be a disclaimer on any page selling a licensed character asset that the character can only be used for personal projects, not sold or used to endorse other products or organizations (whatever the legalese would be).

You can contact TS by clicking on the Support button and opening a support ticket, or call and discuss the situation with them. This sort of thing should never happen.

And you're right about there not being much in 3D to appeal to women or kids. The market--both buyers and sellers--is heavily dominated by men and oversaturated with objects appealing to "traditional" male interests. You've made a good point about there needing to be more original, cute characters. Hopefully, we'll see more of that in the future. Maybe you can learn 3D and exploit this niche yourself. :)

Well, I actually did my first model yesterday.  A lemonade stand.  It was really cute.  I modeled it in Carrara 5.  I textured it in Poser6.  I learned my first lesson.  Texturing "Lemonade....5 cents" has to be a backwards texture for the sign I made to go in front of the stand.  I just began using Poser in 9/05.  I wanted a lemonade stand and could only find one with an outfit for one of DAZ3d Mil girls.  It wasn't what I had in mind and I was not going to spend the money.

I textured it in yellow and white stripes.  As I am writing this, it sounds silly.  However, I was so pleased with myself.  It took me only 15 hours to model and texture.  I had written on the Renderosity board about anyone who would just give me a few pointers and I uploaded a pic from the net I found.

This guy had modeled and textured it in about 20 minutes and messaged me with it and a little tutorial on what to do.

20 minutes, huh????  Mine...15 hours....oh, well.  Anyway, I have put word into the support team.  I am VERY disappointed, however, hopefully they will give me a refund.  That is such a shame.

Thank you for responding and helping.
